Consignment terms

This page describes how NBSportCards consignment works. It is a summary. It is not the contract.

Review the Consignment Agreement

An actual consignment requires execution of the separate NBSportCards Consignment Agreement. Nothing on this website, and no email or message exchanged before that Agreement is signed, creates a consignment or obligates either side. The Agreement is completed and signed electronically.

What the Agreement covers

The Consignment Agreement is the document that governs the relationship between you, as consignor, and NBSportCards. Among other things it addresses the cards being consigned, the consignment period, the commission and how it is calculated, the lowest price you authorize, how marketplace fees and shipping expenses are handled, what happens on a buyer return or chargeback, how and when proceeds are paid, and how either side ends the arrangement and the cards are returned.

Which document controls

If there is any conflict between the general website Terms of Use and an executed Consignment Agreement, the executed Consignment Agreement controls with respect to the consigned property and the consignment transaction. The Terms of Use continue to govern general use of this website.

Ownership and authority

By consigning a card you confirm that you own it or are authorized to sell it, that it is not subject to any lien, claim, or dispute, and that it is not stolen, counterfeit, or altered. NBSportCards may decline or return any card at its discretion, including after it has been received.

Pricing

Pricing is proposed by NBSportCards and agreed with you. The Agreement records the lowest price you authorize. Cards are not sold below that price without your approval. Nothing on this site is a prediction or guarantee that a card will sell, or of the price or timeframe in which it might sell.

Grading

Grades and certification numbers shown for graded cards are those assigned by the grading company. NBSportCards does not grade cards and does not warrant a grading company's opinion. Raw cards are sold ungraded, and no representation is made about how a card would grade if submitted.

Insurance

NBSportCards makes no representation on this page regarding insurance coverage for consigned property. Any insurance arrangements, and responsibility for arranging them, are addressed in the Consignment Agreement and in the shipping instructions provided when a submission is accepted. Raise insurance before you ship anything.

Privacy of consignor information

Consignor identity and consignment records are not published on this website. A consigned card is listed as part of NBSportCards inventory without identifying the consignor, unless you specifically authorize otherwise. See the Privacy Policy.

Governing law

Consignment matters are governed by Florida law, and any proceeding arising from them shall be brought in a state or federal court having jurisdiction in Hillsborough County, Florida, except as the executed Consignment Agreement provides otherwise.
